Hamilton transport company fined for underpaying truck driver

A transport company at Hamilton in South-West Victoria has been fined $25,000 for underpaying one of its truck drivers.

The Melbourne Magistrate’s Court imposed the penalty on Ron Priddle Transport and Logistics Pty Ltd following a prosecution by the Fair Work Ombudsman.

The Court also fined the company’s director, manager and shareholder, Ronald Harold Priddle, a further $5000.

The Fair Work Ombudsman initiated the legal action over a $5300 underpayment of a long-distance truck driver between January, 2007 and January, 2008.

It told the Court the driver was underpaid his loading and unloading allowance, living away from home allowance, annual leave entitlements and superannuation. 

The driver was back-paid his entitlements, plus interest, last month.

It was alleged that Priddle was also involved in his company failing to comply with a Fair Work inspector’s request to provide employment records relating to the truck driver.

Under workplace laws, employers must comply with requests from inspectors to provide employment records relating to employees and former employees.
